NYC Broker Fee Shake-Up: Here’s What You Need to Know

As of this past week, the game has officially changed. The FARE Act is now in effect, and it flips the old broker fee system on its head.

What does that mean in plain English? Simple: whoever hires the broker, pays the broker.

No more renters getting hit with a five-figure fee for a broker they never asked for. If a landlord hires the broker, the landlord pays. If a tenant hires a broker to help them, they pay. Straightforward. Transparent. Fair.

Are there grey areas that need to be fleshed out? Sure. But on the whole, this does what it needs to do. And the requirement that landlords explicitly disclose all fees that tenants must pay before signing a lease is the transparency we all need.

Most of the brokerage community has been groaning,“this law isn’t good, rents will just go up.” Most certainly. But let’s be real: spreading costs across monthly rent is a lot more manageable than dropping thousands upfront before you even unpack a box. Particularly for someone you didn’t hire. That’s not a loss. That’s access.

And while I may be in the minority here, I think it puts value where it belongs—on who’s actually benefiting.

Shoutout to Council Member Chi Ossé for pushing it through, special shout out to Anna Klenkar for shaping it, and to the courts for letting it stand.

Broker fees aren’t gone. They just got reassigned.

Know who you hired. Know who you’re paying. Welcome to the new rules of the game.
